In Deutsch-land gab das BVerfG 2003 den Fall der angehenden Lehrerin Fereshta Ludin, welche sich weigerte, das Kopftuch während des Unterrichts abzulegen, an die Landesparlamente ab. Bis dato sprachen sich sechs Landesparlamente für ein Verbot des Kopftuchtragens von Lehrerinnen aus.
Viele europäische Gesellschaften werden sich öffentlich wie auch politisch verstärkt ihrer nationalen Minderheiten bewusst. Zumeist werden hierbei Problematiken im Zusammenhang mit Integration und der öffentlichen Wahrnehmung von Menschen mit Migrationshintergrund debattiert. In solchen gesellschaftlichen Spannungsfeldern erkennt man die Notwendigkeit für sachlichere und vermehrt akademischere Diskussionen, welche sich mit den neuen multikulturellen Gegebenheiten befassen und nach adäquaten Lösungen suchen, um den demographischen und ethnischen Veränderungen zu begegnen.
Solche normativen Grundentscheidungen bezüglich des Verhältnisses von Staat und Religion, wie sie in der Kopftuchdebatte in Frankreich oder auch Deutschland getroffen wurden, betreffen die Chancen und Grenzen kultureller Pluralisierung einer Gesellschaft. Norwegen hat in ähnlich geführter Debatte eine der französischen entgegengesetzte Entscheidung getroffen und gegen ein Kopftuchverbot votiert. Norwegen ist eine sehr junge Nation, welche erst 1905 gegründet wurde. Sie setzt sich stark für Menschenrechte und Prinzipien der Nicht-Diskriminierung ein. Doch Norwegen ist ebenso ein Staat mit einer christlichen Staatskirche. Seit den siebziger Jahren muss sich auch Norwegen der Situation stellen, ein Einwanderungsland zu sein und sich mit religiöser Pluralität zu befassen. Ausgehend von der historischen und soziokulturellen Gesamtsituation soll diese Arbeit am Beispiel von Norwegen aufzeigen, inwieweit sich die Beziehungen von Christen und Muslimen entwickelt haben. Ich werde diese Thematik anhand des veränderten Selbstverständnisses dieser noch sehr jungen Nation diskutieren und den Schwerpunkt auf Religion in der Schule und das Verhältnis zwischen Staat und Religion und damit einhergehende Debatten und Problematiken setzen, um daraufhin die Kopftuchdebatte einzubeziehen.

1. Themeneinordnung & sachanalytische Betrachtung


Bevor man speziell auf die Ziele, die Vorraussetzungen und die Inhalte der Unterrichtsstunde eingehen kann, sollte zunächst das eigentliche Thema der Stunde in seiner Gesamtheit und losgelöst vom Unterrichtsgeschehen betrachtet werden. Angesichts einer ständig anwachsenden Zahl an Erwerbslosen in Deutschland war man dazu aufgefordert und auch gezwungen Reformen zu entwickeln, welche eine anhaltende und steigende Massenarbeitslosigkeit in Deutschland aufhält und gleichsam reduziert. Dazu wurde eine Kommission ins Leben gerufen, welche eine grundlegende Reform des Arbeitsmarktes und eine gleichzeitige Entlastung der Staatskasse zum erklärten Ziel hatte. Diese Expertenrunde, unter der Leitung von Dr. Peter Hartz, sollte also Vorschläge unterbreiten, wie die Bundesanstalt für Arbeit neu strukturiert und die Arbeitsmarktpolitik effizienter gestaltet werden kann. Außerdem wollte man diesen Arbeitsmarkt so ausbauen, dass er flexiblere Maßnahmen duldet, sodass Arbeitssuchende wieder schneller in die Beschäftigung geführt werden können. So also im Jahre 2002. Da durch die erwartenden verschiedenen Maßnahmen innerhalb der Hartz-Reformen Schwierigkeiten beim Gesetzgebungsverfahren zu erwarten waren, wurden diese aufgeteilt und schließlich in die Pakete Hartz I, Hartz II, Hartz III und schließlich Hartz IV untergliedert. Letztgenanntes trat als abschließendes Gesetz am 1. Januar 2005 in Kraft. Im folgenden soll nun eine inhaltliche Klärung der verschiedenen Hartz-Gesetze folgen.

Das staatspolitische Gewaltmonopol dient der Eliminierung der Gewalt aus dem Gemeinschaftsleben; Gewaltfälle werden zu Rechtsfällen. Sozialpsychologisch spricht man von Opfergerechtigkeit, Solidarität mit dem Opfer und der kontrollierten Vermeidung von Lynchjustiz. Individualethisch steht die Verantwortungsübernahme oder Verantwortungsfeststellung im Vordergrund. Wenn Strafe sein muß, dann vor dem Hintergrund des Strafrechts bzw. Strafprozessrechts als Ausdruck des parlamentarisch legitimierten staatlichen Gewaltmonopols. Damit ist die Strafe in jeder Hinsicht gerechtfertigt. In der Strafausübung drückt sich die Vielfältigkeit der eigentlichen Aufgabe des Strafrechts aus: Pönalisierung sozialschädlichen Verhaltens, Rechtsgüterschutz (BVerfG NJW 1975, 576), Geltungsanspruch mit Rechtszwang (Grundrechte), Strafwürdigkeit und Strafbedürftigkeit werden hier abschließend aufgezeigt. In den Rechtssätzen sämtlicher Rechtssysteme der Welt finden sich elaborierte Systeme des Umgangs mit Strafe. Die Diversion hat hiermit nur am Rande zu tun. Sie ist in den Rechtsordnungen mehr oder weniger klar akzentuiert hervorgehoben. Nicht in allen Ländern versteht sich der Gedanke der Diversion. Die den Rechtsordnungen zugrundeliegenden Zwecke des Strafrechts sind allzu vielfältig:
Während teilweise absolute Straftheorien die Rechtfertigung der Strafe allein aus dem Gebot der Gerechtigkeit herleiten - die Strafe also keine sozialen Zwecke verfolgt und allein der Wiederherstellung des Geltungsanspruchs der gebrochenen Norm in der Reinform der Vergeltung dient - herrschen in der Vielzahl der Rechtsordnungen nur relative Straftheorien, die erheblich differenzierter die Strafe ableiten. Hier ergänzen sich die drei Gedanken der Rechtfertigung der Strafe aufgrund der grundsätzlichen Aufgabe des Staates, Straftaten zu verhindern (Prävention), der Gedanke, tatsächlich auf die Perspektive des Täters abgestellt einerseits - negativ - abzuschrecken und zu sichern, anderseits - positiv - zu erziehen oder zu bessern, also zu resozialisieren und schließlich der Gedanke der Perspektive der Öffentlichkeit, die Strafe durch - negativ - Abschreckung undpositiv - Stärkung des Normvertrauens auf die Allgemeinheit wirken zu lassen. Vor dem Hintergrund dieser allen demokratischen Rechtsordnungen zugrundeliegender relativen Straftheorien steht dem Strafrecht regelmäßig eine Fülle von Aufgaben und Funktionen zu, die zusammengefasst die Basis der Strafrechtsordnungen ausmacht.

This latest addition to ABC-CLIO’s Ethnic Groups of the World series follows the series format: each alphabetically arranged entry contains the name and alternative name of the group; describes the major population areas each group inhabits; offers estimated population; and provides a short sketch of linguistic and religious affiliations, among other information. More than 150 different groups are profiled, organized alphabetically by name. Entries average one to two pages, with the largest portion of the text devoted to the historical development of each group. Groups profiled include Aborigines, Australians, Hindis, Javanese, Parsis, and Tagalogs. The entries conclude with a few print (but no Internet) references. Black-and-white illustrations are interspersed throughout the text, and a geographical and keyword index provides easy access. Unfortunately, the three broad regional maps placed at the beginning of the volume don’t depict the location of each group’s habitation. Some references list hard-to-find or academic materials, but that might be expected because so little has been written on many of these small, isolated ethnic groups. Gerhard Schröder etwa wurde als Medienkanzler bezeichnet, weil er den Umgang mit Fernsehen, Hörfunk und Presse meisterhaft beherrschte. Auch noch so renitente Politiker und andere Personen des öffentlichen Lebens beginnen zu erkennen, dass ihre Arbeit ohne Medien nicht mehr funktioniert – ein Merkmal der Mediengesellschaft? Doch was ist es, dass die heutige Gesellschaft in Bezug auf Medien charakterisiert? Eine Antwort auf diese Frage ist natürlich zu komplex, um sie an dieser Stelle in einem kurzen, einleitenden Kapitel abzuhandeln. Dennoch soll versucht werden, auf Probleme hinzuweisen, Denkanstöße zu geben und die ein oder andere These zu wagen. [...] Die Frage ist nun, in wie weit die Ereignisse in der Ukraine für die deutsch-russischen Beziehungen zu Beginn des folgenden Jahres von der ausgewählten Presse immer noch als belastend gesehen werden, oder welche anderen Faktoren als fördernd oder hemmend für die Beziehungen dargestellt werden. Ganz konkret wird dabei neben den Ereignissen in der Ukraine noch auf die Sicht der Presse zum Zustand der Demokratie in Russland und zu der persönlichen Beziehung zwischen Bundeskanzler Gerhard Schröder und Präsident Wladimir Putin eingegangen. Es ist wichtig, folgendes immer im Hinterkopf zu haben: Es geht in dieser Arbeit nicht um die deutsch-russischen Beziehungen, wie sie in besagtem Zeitraum de facto waren, sondern um deren Perzeption und Darstellung durch die Presse. Kapitel 2 dieser Arbeit wird diese wichtige Unterscheidung genauer erläutern.
