Richardson, of the series Genders and Sexualities in the Social Sciences. She received her doctorate at the University of Manchester, UK.

Dabei verdeutlichen die vielen Unternehmensinsolvenzen die Stagnation ebenso, wie die hohen Arbeitslosenzahlen. Zu erwähnen ist, dass die in den letzten Jahren betriebene Wirtschafts- und Gesellschaftspolitik nicht nur dem Wirtschaftswachstum im Weg steht, sondern auch die Abwanderung zukunftsorientierter Unternehmen ins Ausland fördert. Des Weiteren muss angeführt werden, dass nicht nur die anhaltende Rezession sondern auch die zu hohe Regulierungsdichte auf dem Arbeitmarkt zur Hemmung der Wirtschaft führt. Hierbei ist festzuhalten, dass die Überreglementierungen auf dem Arbeitsmarkt eine große Hürde für die Schaffung neuer Arbeitsplätze und Existenzgründungen darstellen. Damit lässt sich die Frage nach den Gründen für die erwähnten Probleme der Volkswirtschaft zumindest teilweise auf das schwerfällige Arbeitsrecht und die veraltete Tarifordnung zurückführen.
Aus dieser prekären Situation heraus ergibt sich die Schlussfolgerung, dass alle Möglichkeiten ausgeschöpft werden müssen, welche der Sicherung und Schaffung von Arbeitsplätzen dienen. Ziel muss es sein die arbeitsrechtlichen Rahmenbedingungen näher an den betrieblichen Bedürfnissen auszurichten, um so zu einer Förderung der Beschäftigung zu gelangen. Die Modernisierung des Arbeitsrechts in Form einer Flexibilisierung scheint also nötig zu sein, da eine solche Entwicklung helfen könnte, Einstellungshemmnisse in den Unternehmen abzubauen und die Schaffung und Sicherung von Arbeitsplätzen zu fördern.

Dabei liegt der Schwerpunkt dieser Arbeit auf der Diskussion rund um die Umsetzung einer betriebsnäheren Lohnpolitik durch eine Tariföffnung in Form einer Änderung des Günstigkeitsprinzips, welche durch tarifvertrags- und betriebsverfassungsrechtliche Fragestellungen geprägt ist.

Die Hauptfigur der Geschichte sei hierbei anzusehen als die Symbiose der historischen Person Hans Kohlhase mit zentralen Reflektionen Kleists. Der Autor leistet es, die konkret geschichtliche Vorlage mit der rechts- und moralphilosophischen Diskussion seiner Zeit zu verknüpfen, verleiht Michael Kohlhaas so eine Tiefenschärfe und lässt den Protagonisten als komplexes, reflektierendes Individuum entstehen.

In dieser Arbeit werden das Leben des Michael Kohlhaas, das Unrecht an ihm, die gewalttätige Reaktion und sein endgültiges Verhängnis mit der Rechts- und Moralauffassung der Hauptfigur verglichen. Eine zentrale Fragestellung ist hierbei, ob und in wie weit Selbsthilfe und Widerstand bei staatlichem Versagen (moralisch) rechtens sind. Eine Analyse der Stellungnahme des Autors zu seinem Werk oder Angaben darüber, wie er den Erzähler über seinen Protagonisten werten lässt, wird diese Hausarbeit auf Grund der Fülle der Informationeninnerhalbder Hauptfigur nicht leisten. Eine formale Untersuchung leistet diese Hausarbeit ebenfalls nicht, da die inhaltlichen Aspekte und die Frage nach ihrer Anwendbarkeit auf die Diskussionen zur Zeit Kleists klar im Mittelpunkt stehen.

Obwohl diese Arbeit Michael Kohlhaas als individuelles Subjekt behandelt, wird das Hauptaugenmerk auf seinen objektiven, universalisierbaren Anspruch gelenkt. Eine Diskussion seiner ausschließlich subjektiven, triebleidenschaftlichen Rachenatur kann nur marginal vorgenommen werden. Die sogenannte Kapselepisode (für das Rachemotiv ein wichtiger Aspekt) wird so etwa auch nur dann zur Sprache gebracht, wenn sie einen Einblick in die objektive Reflektion der Hauptperson bietet.
