Dies änderte sich mit dem Inkrafttreten des Übereinkommens zu Errichtung der Welthandelsorganisation (World Trade Organisation - WTO) am 01. Januar 1995. Das WTO Überein-kommen ist das Ergebnis langwieriger Verhandlungen im Rahmen der so genannten Uruguay-Runde zwischen den Jahren 1986 bis 1993. Diese Übereinkünfte haben das GATT 1947 in etlichen Bereichen ausdifferenziert und die Reichweite des internationalern Wirtschaftsrechts durch die Einbeziehung des Dienstleistungshandels und des geistigen Eigentums erweitert. Weiterhin haben sich die WTO Mitglieder verpflichtet, Streitigkeiten über ihre Rechte und Pflichten aus diesen Übereinkünften nach den Regeln eines Streitschlichtungssystems beizulegen. Dies ist in dieser Form im Völkerrecht einmalig und hat die WTO im Vergleich zum GATT stark verrechtlich und zu dessen Erfolg beigetragen.
Ziel des damaligen GATT`s und heute der WTO ist der Abbau von Zöllen und sonstigen Handelshemmnissen, sowie die Beseitigung von Diskriminierung, was zu einer allgemeinen Erhöhung des Lebensstandards führen soll. Ziel dieser Seminararbeit soll es sein ansatzweise Gesamtzusammenhänge und Grundstrukturen des GATT und der WTO aufzuzeigen. Es soll die historische Entwicklung des GATT und der WTO beleuchtet, sowie dessen Grundprinzipien und wichtigsten Regelungen vorgestellt werden.
Zunächst soll die Entstehungsgeschichte des GATT und der WTO bis zur Uruguay-Runde erläutert werden. Der Fokus dieser Seminararbeit liegt auf der neuen WTO und den damit verbundenen Grundprinzipien des GATT 1994. Die Grundprinzipien werden anhand der wichtigsten im Übereinkommen festgeschriebenen Artikel erläutert. Als letztes soll das neue Streitschlichtungssystem der WTO dargestellt werden.
